Throughout these Terms, "Bitefolio," "we," "us," and "our" refer to Bitefolio LLC. "You" and "your" refer to the individual user accessing or using our Service.

2. Acceptance of Terms

By downloading, installing, or using the Bitefolio mobile application and website (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to any part of these Terms, you must not access or use the Service.

You must be at least 16 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Description of Service

Bitefolio is a community-driven recipe platform that allows users to discover, create, save, and share recipes. The Service is provided as a digital product accessible via our mobile application. Core features are available free of charge, while advanced features are accessible through a paid Pro subscription (see Section 5).

4. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your account credentials.
• Notify us immediately at info@bitefolio.app of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

5. Subscription & Pricing

Bitefolio offers a Pro subscription plan that unlocks the full set of premium features within the application.

Prices are listed in United States Dollars and are inclusive of any applicable taxes unless stated otherwise. We reserve the right to change subscription pricing at any time. Any price changes will be communicated to active subscribers at least 30 days in advance, and continued use of the Service after the effective date constitutes acceptance of the new pricing.

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us at info@bitefolio.app. Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until that date.

6. Payment Processing

All payments for Bitefolio Pro subscriptions are processed securely by Flitt, a certified payment service provider. By purchasing a subscription, you authorize Flitt to charge your chosen payment method for the applicable subscription fee on a recurring basis.

We accept the following payment methods (subject to availability in your region):

• Visa credit and debit cards
• Mastercard credit and debit cards
• Other payment methods supported by Flitt

Your payment information is transmitted directly to and stored by Flitt in accordance with PCI DSS security standards. Bitefolio LLC does not store your full card details on its own servers. By completing a purchase, you also agree to Flitt's terms of service and privacy policy.

If a payment fails due to insufficient funds, expired card details, or other issues, access to Pro features may be suspended until the payment is successfully completed. We may attempt to retry failed payments within a reasonable period.

7. Product Delivery

Bitefolio Pro is a digital subscription service. There are no physical goods involved, and no shipping or physical delivery is required.

Upon successful payment confirmation from Flitt, access to all Pro features will be activated immediately within your Bitefolio account — typically within a few seconds of payment processing. If your Pro features are not activated within 15 minutes of a confirmed payment, please contact us at info@bitefolio.app with your transaction reference number and we will resolve the issue promptly.

Pro access is tied to your registered Bitefolio account and is non-transferable to other accounts or users.

8. Refund Policy

Because Bitefolio Pro is a digital service with immediate delivery, all sales are generally final and non-refundable once the subscription has been activated and Pro features have been made available to your account.

However, we will consider refund requests on a case-by-case basis under the following circumstances:

• Technical failure: You were charged but Pro features were never activated and we were unable to resolve the issue within 48 hours of your report.
• Duplicate charge: Your account was charged more than once for the same subscription period due to a processing error.
• Unauthorized transaction: A payment was made without your authorization, subject to verification.
• First-time purchase: If you are a first-time subscriber and request a refund within 24 hours of your initial purchase, having not made significant use of Pro features, we may issue a full refund at our discretion.

To request a refund, contact us at info@bitefolio.app with the subject line "Refund Request" and include your account email address and the transaction reference number provided by Flitt. Refund requests must be submitted within 14 days of the charge. Approved refunds will be processed back to the original payment method within 5–10 business days, subject to Flitt's processing timelines.

Refunds will not be issued for subscription periods that have already elapsed, for dissatisfaction with features that were accurately described at the time of purchase, or for violations of these Terms that led to account suspension or termination.

9. Acceptable Use

You are responsible for your use of the Service and for any content you provide, including compliance with applicable laws. You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Infringe the intellectual property or privacy rights of any third party.
• Upload, transmit, or distribute any malicious code, viruses, or harmful software.
• Harass, abuse, threaten, or harm other users of the Service.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Scrape, crawl, or use automated tools to extract data from the Service without our prior written consent.
• Use the Service for any commercial purpose not expressly authorized by us.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision.

10. User Content

You retain full ownership of any recipes, photos, notes, and other content you submit to the Service ("User Content"). By submitting User Content, you grant Bitefolio a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display your User Content solely in connection with providing and improving the Service.

You represent and warrant that you own or have the necessary rights to submit your User Content, and that it does not infringe upon the rights of any third party. You are solely responsible for your User Content and any consequences of sharing it.

We reserve the right to remove any User Content that, in our sole discretion, violates these Terms or is otherwise objectionable.

11. Intellectual Property

The Service and its original content — including but not limited to the Bitefolio name, logo, design, software, and features (excluding User Content) — are the exclusive property of Bitefolio LLC and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without our prior written consent.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service. Upon termination, your right to use the Service will immediately cease. If you have an active Pro subscription, you may be entitled to a pro-rated refund for the unused portion at our discretion.

You may delete your account at any time through the app settings. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Bitefolio LLC, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your access to or use of (or inability to access or use) the Service, even if we have been advised of the possibility of such damages.

In any case, our total aggregate liability to you for all claims arising out of or relating to the use of the Service shall not exceed the total amount paid by you to Bitefolio LLC in the twelve (12) months immediately preceding the event giving rise to the claim.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bitefolio LLC is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction, unless otherwise required by applicable consumer protection law in your country of residence.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect — via email, an in-app notification, or a prominent notice on our website. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the new Terms, please stop using the Service and cancel any active subscription.
